Why would he agree? He paid for the horse.

The wrongdoers here are the people that run Presque Isle.

What Lamboguy has to do is contact the District Attorney and report that
a crime has been committed against him.

The crime is know as Commingling.

in the state of Pennsylvania you are going nowhere with the racing commission and the state police. they aren't interested in working, they are only interested and getting their paychecks and whatever favor's they get along the way. sad but i had a slam dunker and got nowhere with them . they are professional run around artists. i got a great play the last 2 days on this with Ray Paulick and the Bloodhorse. before they took up this case the stall was in for a month, today its down to 2 weeks. the way i look at it, i got something like a 20% shot to get paid for the claim. by no means am i the favorite right now. there are some legal precedents where it could be ruled that the horse that was claimed is still legally mine. they might find the money to pay the claim because that one can be real messy going forward. i have to hope that some lawyer is telling them to pay it off and try to beat everyone on the purses.

the explanation that has been presented so far for not paying the purses is that the money was moving around from the left pocket over to the right pocket and criss- crossed backwards over to the rear right then over to the rear left and finally up the middle. the explanation for the claim money being lost is that the bookeeper mixed up the claim money with the purse money. its take these guys 5 weeks to dream up these lame excuses, tomorrow they will have another story like their 89 year old mother took off with the money.

I'd bet buried within all that there is a federal charge of some kind.

That's the saddest part of this whole thing to me. In any other industry, if a bookkeeper makes that kind of mistake, they're fired. I worked for a travel company as CFO and we had to pay fines if we allocated passenger monies to the wrong trip. There were rules regarding escrowing of funds until departure, etc. Yet in our industry it's just a free-for-all.

It's just inconceivable that any business these days would either use the excuse that they were completely incompetent, or be completely incompetent.

its Tuesday October 28 and still no payment has arrived and no real date as to when its going to get paid

i can only hope that when its time for Mike Pegram to collect his share of the purses that he will get for the Breeders Cup doesn't take as long as it takes for the race track he is invested in, Presque Isle to pay the purse and the claim money they owe. i am betting he gets paid before me, i wish they had a line on it.

I think MP can take that bet unless in some way shape or form the NFL has restricted rights to it!

The horsemen should boycott the next race meet and seriously consider filing a lawsuit against Presque Isle. What a joke. Its time for them to stop making excuses and just get it done.

While we don't personally know each except for the fact that we hang out in the same neighborhood here on Pace Advantage Boulevard, I do 'know' of the problem because, sadly, it's happened to far few many owners here in Pennsylvania.

I have a similar, and in some way, 'worse' story about an owner at Parx.... he put in $20,000 or so to claim a horse. He put the claim in but was out-shook. This was on a Monday or Tuesday and the immediate Saturday personally went up to the Bookkeeper's office to withdraw his money.

You all know where I am going... he was told because it was a weekend the funds wouldn't be available. He reminded them it was his money in his cash account put there to claim a horse that he didn't claim, and not funds from any purses owed him. Still, no such luck. Threats to see the bosses went unheeded simply because those clowns are hardly ever on site during the weekend!

He sent his trainer up there on the following Monday... again they got the brush off. Now, please understand that both owner and trainer are in 'good standing' and have been racing at Parx for many, many years.

I don't know exactly when he got his own money back but it was within a week after a well-placed phone call by a pretty persuasive and connected
lawyer.

I truly sympatize with you lambo because this type of criminal behavior by track management is becoming too frequent.

Did he have the money in his account beforehand or did he put cash in the account the day he wanted to claim the horse? Normally the horsemans book will hold the cash off to the side and return it should the claim not be successful. If the money had been in his account previously then he just needs to request a check from the horsemans book and other then Wednesday and Thursday they are there 5 days a week. I have never had an issue at Parx for the past 11 years.

I captured this message and posted it on my State Senator's facebook page. He is in a tough election bid so I hope he does something quick. Will relay what I learn from Sen. Solobay's office.

“I completed the wire transaction Tuesday and all the checks were sent out Tuesday,” Mostoller said.

That quote is from the Paulick Report. The article is dated October 24, therefore the Tuesday referred to is October 21. Today is October 28.

Should we start a fresh thread about the poor delivery service of the United States Postal Service?

Looks like Ray was handed a fresh pile of manure that matches the piles that have been handed to the Presque Isle horsemen for awhile.
