I don't think so. From a GOP Congressman, Rep. Justin Amash (R-MI):

Quote:
Congress cannot delegate legislative powers to the president by statute.

Among those legislative powers is the power to make appropriations. The national budget is supposed to be managed by Congress and not only should they not cede this power to the executive branch, they are not allowed to do so under the Constitution.

Accordingly, Trump’s attempt to declare a national emergency for purposes of redirecting appropriations for the border wall is constitutionally improper. Trump himself admitted as much in his comments to reporters during a White House Rose Garden press conference on Friday.

Congress can make no law permitting the president to assume permanent legislative powers, even in a single area, simply by his declaring an emergency. The president may act quasi-legislatively only in an actual emergency—when Congress has no time to act—and then only temporarily.

There is no emergency at the border that must be dealt with tomorrow or next week. There is no evidence that there is any more of an emergency at the border now than there was when Trump took office. If there is an emergency, why did he not deal with it then? And certainly anything Trump is discussing as part of his "emergency" is by no means a temporary fix.

Between the choice between the above take on the situation and Trump's emergency, I'd say SCOTUS rules against Trump.

Seems to me that is the National Emergency Act was unconstitutional, the Supreme Court would have said so a long time ago. In either case, I would hope that the Supreme Court takes up the issue much sooner rather than later.

Not if it never came up in a case before them. I think the issue here is not the act, but Trump's application of it.

Agree on both points.

Trump himself said that he did not have to treat it as an emergency, but that he preferred to. How is it partisan pointing out that he himself has defined it as a non-emergency, but he is putting a partisan slant on things?

P.S. I am not registered as a Dem or a Rep. I don't believe in settling for the lesser of two evils.

The do nothings and ultra liberals have turned this country upside down for too long.

t's interesting that you would say this. I think one of the core principals of being conservative is to spend our country's money is a fiscally responsible way; at least in theory. There are those of us - I consider myself to be a fiscal conservative - who do not support the wall, in part, because it is a colossal waste of money in relation to it's need, or lack thereof, and the results it will potentially garner. There are of course other political factors involved in the president's efforts to drive the wall, but to accuse people of being a democrat because they do not support it makes no sense. The point that everybody fails to (conveniently) forget is that the POTUS did not get his funding when he controlled both the House and Senate. Should those republican lawmakers also register as democrats?

He never 'controlled' the Senate, he needed Dems to cross the aisle, a point everybody forgets.

Wrong. McConnell got a lot of things accomplished with a simple majority, despite Dem opposition, by using procedures that were not subject to filibuster.

Trump doesn't know how to work with Congress.

Quote:
The reason President Trump finds it necessary to declare a national emergency stems from the fact that he is not the world’s greatest dealmaker.

If President Trump had signed the budget deal last December, he would have gotten more wall funding than he did after forcing a government shutdown. For two years, Republicans controlled Congress, and no wall was built. If you want to blame the congressional GOP for that, be my guest. But then don’t give sole credit to the president for everything Congress did pass.

I don't care about what political labels people might attach to me, but what I posted was an objective analysis of what Trump is proposing and an opinion of how SCOTUS would rule on it.

My personal opinion about how the border situation should be dealt with matches that of the article I quoted:

Quote:
The president may act quasi-legislatively only in an actual emergency—when Congress has no time to act—and then only temporarily.
The border situation has changed little if any during the 2 years Trump has been in office. Passing the mid-point of his term in office, he realizes that he has accomplished virtually nothing toward a major promise that help him get elected, and that he has little chance of a Dem house allowing it to happen. The declaration of an emergency is pure politics.

I don't like Trump's politics any more than I like those of Pelosi and Schumer.
