City files eminent domain to seize Preakness

Baltimore has filed an eminent domain lawsuit to take ownership of Pimlico and the Preakness. Canada's Stronach Group, which owns Pimlico and Laurel, clearly wants to move the race to Laurel, and no doubt shut down Pimlico. Reports I have seen indicate that Pimlico is a decrepit wreck and not fixable.

This should be an interesting court battle for the next 5+ years. Using eminent domain to seize a trademarked horse race has got to be a first. How will this be improved to help the residents of Baltimore?

The linked article gives a good discussion of the company's position that the race is intellectual property. Eminent domain has always been an issue of government taking real property to use it for a "bigger" purpose. This is like saying we are going to take your house, and the copyrights to all the books that you wrote while you lived there.

There is also the question of who owns the Preakness. Is it the track itself, or the Stronach Group, which currently owns Pimlico, or the Maryland Jockey Club (which is also owned by Stronach) which currently holds the trademark for the Preakness.

there is no helping baltimore, they keep voting for the same type of people for 50 years, nothing will ever change. Just keep the couple blocks around the harbor safe for the weekend I stay there once a year. The town is a lost cause.

As I said in the other thread, even if we assume Baltimore can seize the track, they can't seize a national trademark. That's preempted by federal law. And even if they can seize the trademark, they can't seize the contract with the other TC tracks or NBC. So Stronach will simply change the name of the race and run it somewhere else. And it will still be the second leg of the TC.

I read that the Mayor of Baltimore resigned Monday for personal reasons. Not drugs or depression or to spend more time with family. Reasons Include:

1. Nepotism
2. Greed
3. Self-dealing
4. Cronyism

If they cant fix Pimlico and make is work the state should lose the race. Laurel is far from a premier race track or even a 2nd tier track. Just sell the rights and move it to Monmouth and be done with it. With the giant amount of money Monmouth is raking in from sports gambling they can afford it. Huge purse upgrades this year.

Monmouth needs a little work, but it's one of the tracks that should probably survive long term. It's close to the Jersey Shore vacation destination and will have the resources needed to invest and make it a premier spot for racing.
