Biden admin. withdraws COVID-19 vaccine mandate for large businesses

Nice to see, the administration finally got around to making an official entry in the Federal Register withdrawing the "emergency" OSHA mandate.

But this short paragraph caught my eye:

“Acting outside of its competence and without legal basis, the Court displaces the judgments of the Government officials given the responsibility to respond to workplace health emergencies.”

Whoever made this stupid statement, evidently, doesn't understand that the Constitution was set up in a way that each branch of government would serve as checks and balances against the others.

Moreover, the only real question before the court was the legality of the mandate. To say that that the court's ruling was "without legal basis" was precisely what the defendants failed to establish! They were unable to make the case that the mandate was constitutional. So...which party truly operated "outside of its [legal] competence" here?

OSHA also withdrew their request after ---- after they were getting shredded in court ---- NY Appeals judge reverses State Supreme court decision -- I have to check if 1 judge can reverse State Supreme Court decision

Huh? A State Supreme Court is the highest court in a state. The only court that can overturn it's decision is SCOTUS.
