House of Representatives sues White House on ACA

The House of Representatives today filed suit against the administration for violations of the ObamaCare law.

House Republicans filed a long-threatened lawsuit Friday against the Obama administration over unilateral actions on the health care law that they say are abuses of the president's executive authority.

The lawsuit — filed against the secretaries of the Health and Human Services and Treasury Departments — focuses on two crucial aspects of the way the administration has put the Affordable Care Act into effect.

The suit accuses the Obama administration of unlawfully postponing a requirement that larger employers offer health coverage to their full-time employees or pay penalties. (Larger companies are defined as those with 50 or more employees.)

The suit also challenges what it says is President Obama's unlawful giveaway of roughly $175 billion to insurance companies under the law. According to the Congressional Budget Office, the administration will pay that amount to the companies over the next 10 years, though the funds have not been appropriated by Congress. The lawsuit argues that it is an unlawful transfer of funds.

Why did they wait? If it goes to the Supremes, then it won't get there until 11-2016. After the election. Which means they won't decide until June 2017?

There are scenarios where it could get there earlier, but the likelihood is later.

And, the RINO, cowardly and compromised GOP leadership under Boehner knows this as well!

They want this issue out there for the 2016 elections believing that conservatives will stupidly support and vote for the GOP over Obama Care. The GOP presidential candidate will promise to end Obama Care too, I bet.

The GOP could have ended Obama Care in 2010, 2012... right now, if they wanted to, but they don't want to.

They need an actual alternative plan, not just vague "free market solutions" if they want it to fly...dismantling it ONLY and then just letting whatever happens happens will be a disaster for them...

They are suing to make Obama do something that they hate. Republicans are idiots and anyone who votes for Republicans is also an idiot.

Do you know the meaning of the term mandatory? The appropriation of those funds is mandatory under the law. The only way the House can legally refuse to appropriate those funds is by changing the law. They have not done that. So they are the ones breaking the law. No surprise there. Also these are not funds being given to the insurance companies, except in the broadest sense.

The Obama administration is not unilaterally changing laws. He is delaying implementation of parts of the ACA, because that implementation at this time would place an undue burden on segments of our society. The purpose of the delay is to allow employers to better understand the law and to allow government to better implement it.

Delaying the implementation of a law or parts of a law is something that has been done many times concerning many laws passed by many administrations of many parties. OK two parties. George Bush did it with Medicare Part D. It is not illegal; it is common sense.

What 5 million jobs? There is no evidence that there was any real job lose do the ACA. It is just another made up number by the GOP just like they made up the "death squads". They are losing the fight for public opinion on Obamacare. They now know they don't dare repeal it, so they are dropping it. They figured out just Social Security and Medicare, the longer it is around, the more the public will like it. If they were going to repeal it, they would have to done it just after 2010 elections. This fight is over except for some shouting from the far right of the GOP. Move on to something you might actually win on like Taxes. The GOP is acting like they lost the last election instead of winning it. The seem bound determine to continue there do nothing stance of the four years with a few token votes on things they know they will lose to satisfy their base. The recent pipeline vote was prime example of you can expect for the next year and a half.
