The Jockeys' Guild and the Louisiana Horsemen's Benevolent and Protective Association said July 27 that their members are not subject to rules of the Horseracing Integrity and Safety Authority in any racing jurisdiction in the United States. HISA categorically disagreed except for jurisdictions in Louisiana and West Virginia.

The dispute centers on language in the order entered by U.S. District Court Judge Terry A. Doughty, who wrote that the geographic scope of the injunction is limited to the States of Louisiana and West Virginia, "and as to all Plaintiffs in this proceeding,"

The day after Doughty's order, Jockeys' Guild general counsel Kate Swearengen said in a release the language means all members of the Jockeys' Guild are shielded by the order throughout the U.S.

Shortly after the Jockeys' Guild statement was released, LAHBPA executive director Ed Fenasci said in a release none of its approximately 5,000 members are subject to HISA rules in any jurisdiction, either.

we are all missing a great meet at Lone Star now, maybe they are closed now. i wound up betting a few races with an offshore book that only took the place for a few days. it wasn't that good for me because i like to see the horses in the paddock and on the track before the race.

Effective July 1st, the Texas Racing Commission stripped Lone Star Park's ability to export their signal for simulcasting due to the on-going dispute over HISA. Race wagering was restricted to on-track, other Texas tracks, and selected international sites. For the month of July, average daily handle dropped to about $300,000 per day, not nearly sufficient to cover their purse structure. Longer term impacts remain to be seen, but could be severe.

Just as another plug for RTN (especially with what's happening with TVG) - Lone Star was available live streamed through the end of the meet, and all the replays are available. If you have any kind of decent internet, IMO it is the best $15/month you can spend on a horseracing product.

The CHRB emailed out the following advisory earlier today:

ADVISORY REGARDING HISA COMPLIANCE
Unless and until a federal court clarifies an earlier ruling by indicating otherwise, the California Horse Racing Board will continue to honor its agreement with the Horseracing Integrity and Safety Authority by enforcing HISA safety rules, including the rules covering use of the riding crop, as the CHRB has been doing since HISA rules went into effect on July 1. California stewards are notifying all thoroughbred jockeys in the state of this decision.

This new appeal will be heard by the United States Court of Appeals for the Fifth Circuit.

The Horseracing Integrity and Safety Authority announced July 29 that enforcement of certain aspects of its horseshoe rules would not be enforced when the rule is enacted Aug. 1. Specifically, enforcement shall not apply to horses racing on dirt surfaces that are shod on the hindlimbs with traction devices of either a full outer rim shoe or a toe grab up to four millimeters in height.

The rule change followed a July 19 meeting in Saratoga Springs, N.Y., between the HISA Safety Committee and the Thoroughbred Horsemen's Association board of directors, and representatives of the Kentucky Thoroughbred Association, Thoroughbred Owners and Breeders Association, and Thoroughbred Owners of California. Among the short-term and long-term issues discussed was the shoe rule, which has generated significant concern among horsemen for its potential to negatively affect the safety and welfare of horses, according to THA.

The plaintiffs also filed a request for a temporary injunction.

This is all futile in the end- as I said, it's perfectly obvious Congress has the power to do this. But we have to wait out the clown show for a few months.

Even if you think it is a bad statute, it is clearly constitutional for Congress to do this.
