a theory: the foul was deliberate
After moving out to foul War of Will, the moves back in and crowds Code of Honor. You can see this on NBC's overhead shot.
That makes me wonder if this was deliberate race riding. He was trying to impede his rivals on both sides.

Yes, that's right. He lost some action on the first incident (not deliberate I think) and saw COH filtering on the inside so, deliberately, he goes to the rail and brushes COH.

A 5th race 3YO rolling into the stretch of seeing a packed house of 100K people might freak a bit, or need to change himself up.
We've seen numerous horses do shit like that, they just had the luxury of other horses not being around them when it happens.
I mean shit, Vekoma should have been DQ'd in the Blue Grass. He came over atleast 4 lanes for craps sake.

Having watched it several times more, I think I can prove it was ALL intentional.
He was a path off the rail on the lead, which is typical on a wet track. When the came up behind him, he first moves TOWARD the rail, to shut him off.
Then War of Will goes outside of him, and Maximum Security actually shifts out TWICE (the second one was where War of Will almost clipped heels).
Then, while Maximum Security is several paths out, he suddenly realizes Code of Honor has come through on the inside to get the lead. At that point he panics and moves all the way back and actually contacts Code of Honor.
It was all deliberate. He should be set down and should not be allowed to ride in the Preakness.

Wonder how many bettors lost money on the SA derby when bafferts third horse wasn't going to make the Derby gate unless one of his riders handed him the win by stiffing the horse he was on?

Baffert is responsible for plenty of riding shenanigans. Doesn't excuse what Saez did.
