Jockey Club Rule 19 - Medication Violations

JOCKEY CLUB RULE BOOK

19. DECEPTIVE PRACTICES; CRUELTY TO A HORSE; MEDICATION VIOLATIONS

A. Any person or entity (collectively “Person”) may be denied any or all of the privileges of The American Stud Book in the event:

4. There is a final determination by a court (whether civil, criminal or administrative), an official tribunal or an official racing body that such Person: (a) knowingly misrepresented or aided or abetted the misrepresentation of a horse’s identity, name, age, appearance, pedigree, genetic type or any other information in connection with either entry in a race or the racing of any horse; (b) knowingly misrepresented or aided or abetted the misrepresentation of a horse’s eligibility for registration or any other matter related to The American Stud Book; (c) stole, counterfeited, forged or altered a certificate or document issued by The Jockey Club or knowingly received a stolen, counterfeited, forged or altered certificate or document issued by The Jockey Club; (d) killed, abandoned, mistreated, neglected or abused, or otherwise committed an act of cruelty to a horse; or (e) violated applicable racing authority statutes, rules or regulations relating to horses (i) on one or more occasions involving prohibited or restricted drugs, medications or substances that have been classified by the Association of Racing Commissioners International, Inc. (RCI) as class 1 or class 2 (whether or not so classified in the jurisdiction(s) that made the final determination) or (ii) on three or more occasions in any 365-day period involving prohibited or restricted drugs, medications or substances in any RCI class (whether or not so designated or classified in the jurisdiction(s) making the final determination).

That will be five violations in less than 365 days, three times in G1 races.

• 5/02/2020 Gamine, Oaklawn Park, AOC, Lidocaine
• 5/02/2020 Charlatan, Arkansas Derby, G1, Lidocaine
• 9/04/2020 Gamine, Churchill Downs, Kentucky Oaks, G1, Betamethasone
• 7/25/2020 Merneith, Delmar, AOC, Dextromethorphan
• 5/01/2021 Medina Spirit, Churchill Downs, Kentucky Derby, G1, Betamethasone

That article and a quick review of USADA's sanctions provides a broader perspective on some of the powerful forces at work in the background here playing a major role in how events are evolving.

It will be interesting to watch the next step taken by the NYRA.

What are you going to save for those actually caught with their hands in the proverbial cookie jar?




If you give some college basketball program "the death penalty" merely because its assistant coach, while watching a high school state tournament, pauses to render assistance to a random young player in the crowd who just did something dumb in climbing over a barrier before falling in agony with major cramps in her leg, then what degree of severity will you have left for intentional and covert recruiting violations?

Baffert is a repeat violator. Stop making fatuous comparisons.

Expect long suspensions . . .

  • The Jockey Club should enforce Rule 19 against Baffert.
  • Is Baffert the first trainer w/an entry disqualified for doping in the Kentucky Oaks and the Kentucky Derby?
  • If the Horseracing Integrity and Safety Act survives legal challenges and USADA is their drug enforcement arm, expect long suspensions for doping violations.

I applaud the efforts of the Jockey Club and USADA to rid the sport of doping and encourage both in their continued efforts.
