Perhaps CFPB's own top attorney should return to law school. FVRA states that is the exclusive statutory means for temporarily filling vacant advise and consent positions in the Executive Branch, UNLESS Congress explicitly legislates otherwise. It goes on to say that Congress can "state otherwise" either by authorizing the President, a court, or an executive agency head to fill a vacancy temporarily.

That is what Congress did in the case of the Dodd-Frank law which established the CFPB. Mary McLeod based her (erroneous) opinion on the fact that Dodd Frank did not specifically state that FVRA was not applicable. But as far as I can tell, FVRA does not require that. It only states that Congress has the authority to override FVRA.

I read recently that, unlike Cabinet positions, the confirmation of that position only requires 51 votes in the Senate.
