The CFPB's own top attorney said that Trump had the legal authority for his decision.
Quote:
In a memorandum obtained by POLITICO, CFPB general counsel Mary McLeod said Trump had the legal authority to name an acting director to the bureau under the Federal Vacancies Reform Act.
“It is my legal opinion that the president possesses the authority to designate an acting director for the bureau,” McLeod wrote in the Nov. 25 memo to the CFPB leadership team. “I advise all bureau personnel to act consistently with the understanding that Director Mulvaney is the acting director of the CFPB.”

That is what Congress did in the case of the Dodd-Frank law which established the CFPB. Mary McLeod based her (erroneous) opinion on the fact that Dodd Frank did not specifically state that FVRA was not applicable. But as far as I can tell, FVRA does not require that. It only states that Congress has the authority to override FVRA.

No, just until Trump nominated someone and that someone was confirmed by the Senate.

Thank you, counselor, we will give your legal opinion all the consideration it deserves.
In the meantime, the Judge disagrees with your learned opinion, as does the head attorney for the CFPB, as does the Justice Dept.

Oh, at last count, Barney Frank and Liz Warren do agree with you. So you are certainly in good company there.

The confirmation would never happen with an Obama holdover in charge of the
CFPB.

I read recently that, unlike Cabinet positions, the confirmation of that position only requires 51 votes in the Senate.

The Democrats will filibuster, it takes 60 votes to end a filibuster.

Apparently, now no appointments can be filibustered, only bills.

What I will say right now is when was this done, how was it done, who are the Dem donors. Or, more simply, what is your source for this?
