You gotta pay the winners.
Imagine if you were alive in a pick 5 or 6 for 100k or more (not at Del, just in general) and this happened after your horse won easily in the final leg.
Oops, sorry, no winners of 100k, lets pay to "All" and give everyone a few hundred bucks.

I never understood that bullshit rule, especially when the race was run. Those bets were made already.

I think the key is that they accepted the bet in good faith. Investors aren't interested in hearing "WE had a technical malfunction so YOU lose money".
They accepted the bet in good faith....its absolutely unacceptable to make wagers and have to wonder if they're going to decide to pay you or not. If you bet and you win, you get paid. Period.
If its their mistake, they have to pony up the cash to make it right.

This would happen quite a bit at the smaller night tracks at Tup OTB. By quite a bit I mean at least a couple per month that I would witness.
The screen would say tote delay and all bets were refunded as the tup money never "comingled".
Only had the winner once when it happened, a 12-1 winner at Fairmount.

Well, back in the day, "failure to commingle" was regarded in NY as a "missed pool," and the stakeholders were responsible to pay off at on-track prices. I would think even if 95% of the pool was from inter-track or off-track, someone should have made good. Not familiar with the rules of this state, however.
