Therein lies the rub.
There are laws against “neglect of duty” and every state has different ones. The military has very strict and broad ones.
The use of different tactics to approach different situations were not considered when these laws were written. In fact, the reason these laws are vague is purposeful. So they could be interpreted in many different ways. From sleeping on the job to forgetting your rifle.
I cannot fathom standing by, and in fact hiding, while those kids were getting killed. But that’s just me. I’m sure these kids and their parents expected a response. But the officers defense will always be he was outgunned, etc. then rely on the nonduty to perform ruling
