Casino probably does well because of people like Dutrow, people like him and horse racing industry tolerating them but other horsemen are not bothered and never will be as long they get a slice of the action.

He is just one who sets a bad example, don't group others in with him who are hard workers and stay within the rules of the game. If you are upset that the casino is at Aqueduct that's another issue.

Tom, unfortunately at times, the game doesn't exist outside of the state statutes that protect everyone in the state.
I've gained a modicum of sympathy for stewards and commissions that try to do the right thing from time to time, but unfortunately, know their own rules better than those of the state at large.
The bending over backwards in recent years to afford due process in many cases is a direct result of litigation filed by attorneys (appeals, etc) that can find just one flaw in the process of those presiding over racing and turn the whole shabang on its head.
I don't mean to suggest that penalties aren't tough enough or guys shouldn't be run off with a summary suspension pending a hearing, but the moment anyone within racing does just one itty bitty thing wrong from the perspective of the courts, the groundwork is laid for nothing to happen.
Everyone has an attorney now it seems and what you have now are appellate courts dictating protocol. I don't know what the solution is exactly, but I do know that the "due process" stems less from officials wanting to help out horsemen and more from officials not wanting to be made to look like complete fools on appeal.
