But there is...
We have a President and a President Elect after the first Tue in Nov. Not two Presidents till Jan 20th.
Congress has set the # at 9 not 10 as it would be by nominating and confirming while no vacancy is available to be filled. That is why. We do not have a Bullpen for the Supreme Court.
Joe can proceed after Breyer packs it in and hangs up his robe cause that is how it work under the LAW.

You are hopelessly ignorant. Being nominated does not make you a Justice. Being confirmed does not make you a justice. You only become a justice after you are sworn in.

For God’s sake man, read a history Book. On July 1, 2005 Sandra Day O’Connor announced her intention to retire. But she didn’t officially retire until Jan. 31, 2006. George W. Bush nominated Samuel Alito as her replacement on Oct. 31, 2005 three months before O’Connor retired.
In 2018, Trump nominated Brett Kavanaugh on July 9 three weeks before Anthony Kennedy’s retirement date. It happens all the time.

They don’t need a Republican because Kamala Harris breaks all ties. But, I think with the right nominee they will get a few Republican votes. Not the lunatic fringe Republicans but people like Romney (Ut.) Murkowski (Ak), Sasse (Ne), Portman (Oh) or Twomey (Pa)
