Mullins forced to dismantle stable during 70-day ban

Looks like California's version of the NCAA's Death Pentalty inflicted on SMU years ago. It destroyed the football progarm for SMU for almost 15 years!! Note that the NCAA has never imposed it again!!

California is taking action and sending a signal that they no longer are "winking" at cheaters.

This change is good for California... hope everyone takes note.

Here is the CHRB papers on the matter to sum up.

WEEKLY UPDATE: APRIL 25 – 31, 2011SACRAMENTO, CA – This is the California Horse Racing Board’s weekly update of all complaints and stewards’ rulings involving Class 1, 2, and 3 medication violations and other significant matters.

The members of the California Horse Racing Board, while meeting in executive session on April 28, ruled trainer Jeff Mullins must serve the remaining 70 days of a 90-day suspension handed down for a 2006 violation. This action followed a Board review of the record based on an earlier decision not to adopt the original Proposed Decision of Administrative Hearing Officer Steffan Imhoff.

Mullins served 20 days of a 90-day suspension in connection with a 2006 mepivacaine violation involving the horse Rob’s Coin. The remaining 70 days of the suspension were stayed provided Mullins committed no further Class 1, 2, or 3 violations during the term of his one-year probation. Mullins did have such a violation (TCO2) within one year and he served a 30-day suspension for that new violation. The CHRB then sought to impose the remaining 70 days of the suspension for the original mepivacaine violation. An accusation was filed against Mullins and a hearing to revoke his probation was heard by Imhoff, who proposed reducing the 70 days remaining on Mullins’ mepivacaine suspension to 40 days. The Board, meeting in executive session last December, declined to accept the Proposed Decision, which prompted the review of the record. The Board voted April 28 to approve a modified Proposed Decision whereby Mullins will begin serving the remaining 70 days of a 90-day suspension on June 1, 2011.

Imhoff’s Proposed Decision can be viewed on the CHRB Website (www.chrb.ca.gov) through the links Administrative Hearings/Board Decisions.

How many horses is he training?

From the article, it appears to only affect his presence on-track. What about at training facilities? Are those licensed CHRB licensed too?

Part of the evidence attesting to Mullin’s character related the events surrounding I Want Revenge being scratched out of the 2009 Kentucky Derby Presented by Yum! Brands (gr. I) on the morning of the race.

“On the morning of the race, Mullins discovered some filling in the horse’s left front ankle,” the report stated. “The horse was then examined by respondent’s vet as well as renowned veterinarian Dr. (Larry) Bramlage. The vets advised him that I Want Revenge was not lame could run in the Derby but it was in the horse’s best interest not to run. Putting aside his chance to enjoy the fame and fortune associated with training a Kentucky Derby winner, Mullins did what was in the best interest of I Want Revenge and scratched the horse from the Derby.”

Imhoff said Mullins’ version of events was corroborated by others, concluding “We believe Mullins’ performance at the 2009 Derby demonstrated grace and fortitude under extreme pressure that constitutes evidence of mitigation.”

In seeking lenience, Mullins also described the negative impact the violations have had on his professional career, including a decline in stable earnings from a peak of $4,010,265 in 2006 to $1,234,949 in 2010, while his annual starters have dropped from 519 to 226 and his stable roster has fallen in half.
This year, Mullins has eight wins from 58 starters and a stable bankroll of $379,424. His most recent graded stakes victory came in September 2009 with Carlsbad.

A guy who is on probation and screws up gets what he bargained for. Seems CHRB bent over backwards on more than one occasion for this guy. Dutrow, take notes........
Any owner who sticks by this guy is part of the problem as well. May be a pitchfork in his future?
