Derby Wars

My dad got me interested in handicapping and he and I used to love working the races together. He got sick towards the end of 2016, and I stopped playing the races for a few years, until this year I started back.



I currently live in Reno, so the state of Nevada makes it illegal for us to gamble with anyone that does not bribe (donate enough) to its politicians, which means in state casinos only. So I currently bet thru the Atlantis, but I had previously bet online, mostly with TwinSpires, but with other sites as well including Derby Wars.


This winter, I am going to go visit my mom who lives in Phoenix for a few weeks and I thought I might see about playing some competitions on Derby Wars while I was down there. I logged on to see if I still had any money in my account and surprised to find out that I did, but that Derby Wars had taken it without any explanation. I contacted their customer service, sent them a screen capture of them taking my money and asked why they took it; crickets. No reply.


Has this happened to anyone else?


I would strongly recommend avoiding Derby Wars. When made aware of the theft weeks ago, they have simply not responded. That is not how ethical companies operate. Just wanted to let others know.

All DerbyWars accounts are considered active if they have one transaction per year. If the account has no activity after 3 years, and after attempts to reach the account owner, there will be a $2.99 monthly dormant account fee charged to maintain the account.

At this point, a check will be processed and funds will be returned to the address on file, less administrative fees. The abandonment process is subject to a $20 administrative fee. If the check is returned, then the funds will be escheated to the state of North Dakota within 180-days.
Based on your last activity, and when this started happening, this part of the TOC was added after you left. But, based on other things you agree to when you sign up - they're allowed to change the TOC, including putting in these terms and acting on them.

Not saying it's fair - just went and found an answer that at least explains how it happened in the way it did.

Hey Tom,


Appreciate the effort you did in looking up their clause.


Guess it is legal to steal these days as long as you have a lawyer put a note on your website saying you are allowed to steal your customers' money.


Disappointing, but at least they will not be getting any more of my money...

I checked mine and have $23 in it, put in a 200 point game and might come back in next couple years

This world is much smaller than we all believe.... tbh, I'm just a random player like yourself... but I'll stick my neck out and write an email to them as a non customer and see if we can get your money back. I've always wanted to get into these tournaments and never have...I'm sure we can get your money back, and they can earn some customer good will at the same time. Could be a win/win.

Let me know if you want me to contact them and I will. If those points solved your issue... then all should be well.
