All murders are homicides; all homicides are not murder.

The cop's defense will probably be something along the lines of "I instinctively
reacted to the aggressive brandishing of the taser at me. Yes, I knew it was not a gun, but my self-preservation instinct took over."

Not saying this gets him off, assuming he will be charged, but I don't think this case is as blatant as the Floyd case.

Typical response to all of this - protesters blocked city streets Saturday so that when a Wendy's was set on fire intentionally, firemen were unable to get there before it burned completely to the ground.

I don't know about the mayor, but a taser is NOT considered a lethal weapon.

It is an incapacitating electrical device, and even though its use has sometimes had fatal results (like using a baton), you don't have this right, Tom.

My defense is more plausible.

I read somewhere that 8 or 9 people have died from tasings since 2001. Also, I read, and not everything you read on the internet is true, that officers are trained to tase on limbs-legs or arms, because if you tase the abdomen it is more likely to shock the heart.

To me, this seems to be an unfortunate event. He did fight back and resist arrest. He did try and tase an officer which even if the tase wouldn't directly kill could have left officer incapacitated and vulnerable.

Had the policeman raised his gun and fired while the suspect was in the act of turning and firing the taser - or if he had fired his gun within an instant of that: I think I might see things differently.

But that's not what happened.

The policeman shot the suspect in the back while he was running away.

In my twisted view of reality - that changes things.

That said, in the heat of the moment did the policeman know it was (only) a taser?

Or, in the heat of the moment, did the pursuing officer think the suspect might have relieved his partner of a sidearm as well?

If so, that could change things.

Imo, if this goes to trial, this case could turn out to have a profound effect on the way law enforcement conducts itself going forward.

I say that because I could see a defense attorney making this not just about his or her client reacting instinctively to a suspect's aggressive behavior and brandishing of a weapon.

I could see a defense attorney taking things a step further and making this about the TRAINING all policeman receive.

Maybe a closing argument that ends with a phrase something along the lines of:

"My client did what they trained him to do."

Bingo. After being in a pile fist fighting the police when he turns to fire the officer cannot know if its just a taser or the other officers weapon.



It is a new normal now that when we see all these people fighting the police we completely ignore it and move to what the officer might have done wrong.

Not too sure about this. The officer chasing him has a taser pointed at him, and it appears that the other officer shoots the victim. That means to me that the officer that shot him, was also the one that had his taser taken from him.

But each officer has no idea if the criminal has the other officers sidearm as well. They went from in a pile to the shooting in a matter of seconds.
