These Senate hearings are a joke.

Mark Milley, he of the very ample stomach and oversized ego despite a career of failure, said China was America's greatest enemy.

Yet, Milley called his Chinese counterpart, to give them an alert of a possible -- but unfounded-- nuclear attack. That's called treason.

Milley led the US surrender of Afghanistan yet he left the Taliban over 80 million in arms.

Milley is directly responsible for the deaths of 13 marines at Kabul airport, and for the bombing of an allied civilian family, which killed innocent children.

And yet he isn't held accountable for any of this nor would he even apologise for his incompetency.

It was revealed today in this hearing that 5000 Americans remain in Afghanistan. The Sec. of Defense just now claims that of those remaining only about 100 wish to leave.
My question is : ARE YOU KIDDING ME!!!
Why in hell, given the conditions and dangers that exist there, would anyone with any brain at all want to stay there?

It turns out 46 is correct and I (among others) is wrong. Here is what the Constitution says.
Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

“Levying war” is pretty clear. It means direct action through combat or strategic planning. The confusion comes in what is meant by Aid and Comfort.

Time of war. Treason by aiding the enemy can't be committed during peacetime; there must be an actual enemy for the traitor to aid. The requisite enemy designation typically requires a formal declaration of war.

So Milley can not be charged with treason because there was no war; therefore China could not be an enemy under the definition in the Constitution. Also, the information conveyed by Milley to his Chinese counterpart helped the United States by keeping it out of a potential war with China.

This does not mean a person can’t be tried and convicted for aiding a foreign state. Among the more famous, Ethel and Julius Rosenberg were executed in the early 50’s for spying for Russia.

Well technically we are still at War with North Korea we had an ongoing War in Afghanistan at the time.
