Bob Baffert caught a break. He was judged on what could be documented rather than what might turn up later.

The Hall of Fame trainer was spared a suspension by the Kentucky Horse Racing Commission (KHRC) last month because he is still presumed innocent of two medication violations under appeal and because state stewards were satisfied circumstances mitigated the Kentucky Oaks betamethasone positive of his prize filly, Gamine.

“When something is under appeal, it’s hard to consider it a violation,” chief steward Barbara Borden said Tuesday. “We don’t know what the outcome is going to be."
If Gamine was trained by Jason Servis I'd bet Barbara Borden would have had a different opinion and definition of the term violation.
