I agree to an extent. However, there is really no way for the employer to verify ones immigration status. Forged/Fake documents are so good now it takes Border Patrol three days most times to verify they are fakes. I'm not kidding on that. The only way to do it is not prosecuting an employer if the worker used forged documents. Now hiring day workers for cash is easy to prosecute because they aren't filling out any documentation.
