Did anyone claim foul on RH? Did the stewards call for an inquiry? Did the horse actually commit a foul? Pretty sure the answer to all those questions is a big fat no.

Your last point is spurious. There are lots of things that are legal but unethical, and one reason for this discussion is to think about whether there should be rule changes to discourage what we think happened.
