I believe I read this a while back, but at NYRA, if a horse breaks through the gate right before the gates open he will be DQ'd if the stewards decide that the horse caused the issue, if they feel the assistant starter caused the issue they will scratch the horse.
I think most other jurisdictions just scratch the horse.
