Abraham Lincoln's supreme court lost a chief justice (Roger B. Taney) on October 12 ,1864 IN an election year.
After Lincoln was re-elected, he appointed Salmon P. Chase, a strongly anti-slavery Republican from Ohio, to succeed Taney. December 15, 1864
Precedent enough by a very good and very Republican president..."Let the people decide WHO should appoint a new justice."
