The law doesn't allow for that kind of thinking. The Capitol holds no different intrinsic value than any other building. If he was standing in his garage and shot a trespass suspect climbing thru a window (they are not a burglar until they commit a theft) especially liberal DC he would be up on charges.
Not to mention it was an unsafe shoot with no clear field of fire. There were police officers standing behind her when he fired his weapon. Any decent police dept would discipline him harshly for that.
The bottom line is Trump supporters don't deserve justice. I hope her family goes after the officer in civil court and bankrupts the Capitol police for a few years. Pelosi will just increase their budget to cover it.
