SUMMARY OF CHRB ACTIONS AND DISCUSSIONS 10-6-11


ARCADIA, CA – The California Horse Racing Board conducted its regular meeting Thursday, October 6, at Santa Anita Park. Chairman Keith Brackpool presided. Vice Chairman David Israel and Commissioners Jesse Choper and Jerry Moss were in attendance.

· Chairman Brackpool opened the meeting with an announcement that Executive Director Kirk Breed was ill and unable to attend the meeting. He extended the Board’s best wishes to Breed and their hope for a full recovery.

· Board Counsel Robert Miller read the following statement: “On April 11, 2011, the California Horse Racing Board received a communication from an organization entitled the California Thoroughbred Horsemen’s Association. The purpose of the communication was to inform the CHRB that the California Thoroughbred Horsemen’s Association would be going forward with a petition to decertify the Thoroughbred Owners of California as the organization empowered by the Board to represent thoroughbred owners. In accordance with CHRB Rule 2040, the CTHA has six months to obtain signatures from 10 percent of the qualified members of the TOC agreeing to the decertification. The CTHA thereafter submitted the requisite number of petition signatures. The CHRB staff reviewed the petition to insure those signing the petition were qualified to do so. When the review was completed, the CHRB staff randomly selected 300 signers and sent a letter requesting verification of their signatures. The total of 300 names was chosen to give the CHRB a 95-percent confidence factor that the remaining petition signatures were true and correct. The CHRB is now receiving responses from individuals selected. Some of the selected individuals have indicted that they did not sign the petition or do not remember signing the petition. For those selected individuals who do not respond to the verification, the petition signature will be compared to the signature on their license application. At the November meeting of the CHRB, the staff will report to the Board regarding efforts to verify the signatures on the submitted petition. If the Board determines there are sufficient verifications to proceed with an election, the Board will then decide how and when the election will be held. The TOC has requested the opportunity to address the Board regarding the decertification process. They will be afforded that opportunity at the November meeting. Other interested parties will also be permitted to make presentations to the Board at that time. All persons and organizations wishing to address the Board on this matter are requested to submit their comments in writing to Jacqueline Wagner on or before November 1, 2011, so Board members will have the opportunity to review the materials in advance of the November meeting.” The next Board meeting is scheduled for November 17 at Hollywood Park.
