That article is not very clear about what happened. But as I read it, the man and women went to arbitration. Geico opted not to participate, probably feeling that they were not a party to the dispute since no one from Geico was ever in the back seat.

The result of the arbitration was that Geico would pay the woman $5 million. Geico is trying to appeal the decision, but apparently the courts are ruling that since Geico did not take part in the arbitration, it cannot appeal the results.

The woman claimed that Geico was guilty of “negligent infliction of emotional distress.”
