What the hell is this country coming to? This has to get over turned. I bet the ambulance chaser lawyers are excited about this.

That article is not very clear about what happened. But as I read it, the man and women went to arbitration. Geico opted not to participate, probably feeling that they were not a party to the dispute since no one from Geico was ever in the back seat.

The result of the arbitration was that Geico would pay the woman $5 million. Geico is trying to appeal the decision, but apparently the courts are ruling that since Geico did not take part in the arbitration, it cannot appeal the results.

The woman claimed that Geico was guilty of “negligent infliction of emotional distress.” :pound:

So, I can name a million people in a frivolous suit and if any of them don't spend the money to defend themselves, they owe me the judgement? If this is what lawmakers intended, we have some pretty backward thinking lawmakers. How smart do you have to be to see the lack of justice in this law?

I actually go against party lines on that one. Did you see that woman's injuries? See actually had 3rd degree burns, no reason to make coffee that hot. How many times has a person in a drive thru handed someone a beverage and the lid popped off and the drink spilled on them?
