Got a phone call informing me of the following:

This week at the Meadows, trainer Paul Kennedy (from Michigan I think) is racing on a probationary license due to his positive tests a year or so ago that caused him to be suspended for about a year.... anyway, seems he had three (3) positive tests with two (2) more pending when he appeared before Judge Fred Krystosfiak (sp?)...Seems Judge Fred gave him a verbal warning which means that NONE of these 5 tests will appear in the USTA weekly report posted on their site.

Would you consider this to be a cover-up?

For me, hiding these 5 positives (for an antihistamine) should be investigated.

Fines yes. No days. No suspension (PA or otherwise).

In fact, some of his horses were immediately entered at Chester upon leaving The Meadows last November.

Thereafter, he raced in Toronto, Windsor and even Indiana, until returning to The Meadows in June.

I've no idea how these three tracks would accept his entries under a "supposed" suspension.

After looking back at the archive, you are correct.

You are right as there are no days associated with this. I think it is more important that this be investigated as Mr Kennedy 2010 infractions were both in October 2010...now these possible 5 positive tests in Oct 2011 are being swept under the rug.

PA has a history of unjust (for lack of a better word) penalties.

Some years ago penalties were repealed when a text they were using was inaccurate. And the a similar repeal of penalties took place just a few years later.

Read the controversy between Gural and Foraldo when the Cane Pace was moved to Pocono and the difference in testing between the two states.

Gural comments on New York Senate (Gural comments on New York State Senate Committee testimony)

Lower portion provide some explanation on the differences between states testing.
There was also another press release from some NY official on the NY Drug testing.

Are you aware of the "Class Rulings" (categories) for penalties and the difference in severity?
