There were DUI check points all over Del Mar that day, what a idiot.
He will pay a fat bill over this.

Del Mar is covering up the story to protect one of their own.

From the article,
...well below the speed limit and weave across the lanes of Carmel Valley Road about 11:55 p.m., police Lt. Andra Brown said.
And,
The arrest was not part of a Sheriff’s Department DUI enforcement effort in the area around the racetrack, Brown said, though 15 people were arrested on suspicion of DUI after the races. She said a patrol officer noted Smith was driving 25 mph in a 45 mph zone and weaving into oncoming traffic lanes and the bicycle lane.

Mikey just messed up.

In general, I am familiar with the law. No personal experience.

No one said it would be a walk in the park. Perhaps you misunderstood "messed up" to mean no-big-deal. Doesn't mean that. Maybe I should have said he f'ed up, big time, what were you thinking, or, better, not thinking Mike?

Here is what is going to happen to him if convicted, the outer stater people will be very surprised.

1. A fine up to $3,000.00

2. Six months of AA meetings

3. 2 months of DUI school or 8 weeks

4. Restricted license

5, Probation for 2 years

6. His insurance company will be contacted by the State and he will be put into the high risk category.

7. His attorneys fees and costs

The time he is done, he will have over 7 grand into that ticket.

The money doesn't mean nothing to him, however, his time at the DUI School and AA meeting does.

Second time around, he will go to jail

Plus will have trouble crossing the border into Canada.

Needs to get the charges reduced/amended to something other than DUI.

Exactly.

It happened off the track.

He's human.

I said on the other thread ..there but for the grace of God go I, and I meant it.

Are you all saying that you've never made a mistake?

Let it go.

It doesn't make him any less of a great jockey.

Made a mistake, Drinking and Driving is never a mistake.

If he pleads guilty, he gets what he deserves
