U.S. Middle District Judge John E. Jones III has refused to dismiss a lawsuit filed against jockeys at Penn National Race Course by a race horse owner and a trainer who were ousted from the track.

Adamo and Gill also are suing the state Horse Racing Commission, challenging the validity of their ouster. In March, Middle District Senior Judge Sylvia H. Rambo rejected a bid to dismiss that suit.

I do miss deciding whether to throw out Gill's cripples or not

This deal opens up a whole new can of worms, as if we don't have enough to chew on. If the paddock judge, state stewards, race secretary, ect...allowed his horses to go to post and the jockeys banded together to boycott, well you get the picture. Now is the time for someone to step up and accuse all of them of collusion, ect.....Gill kept the box full, and that will be a factor to be looked at, for better or worse. Running cheap, lame horses that (gee, imagine this....) feed the vets, should be looked into. If the track is a private entity, then defendants should prevail however, given the right to refuse entry to anyone ala card counters in Vegas.....nothing "illegal" but detrimental.
Not a fan of his assembly line operation, with little attention to the horse, and for this he should be punished somehow. Barred from the track is a start.

I said right from the get-go that Gill has an excellent chance to win this suit. The jockeys at Penn National are going to have to dig into their pockets when all is said and done.
