Obama solicitor general: If you don't like mandate, earn less money

President Obama's solicitor general, defending the national health care law on Wednesday, told a federal appeals court that Americans who didn't like the individual mandate could always avoid it by choosing to earn less money.

Incredible...first the administraion said there was NO mandate...no the solicito general says if you want to avoid the mandate (which again I thought didnt exist)...just earn less!!

I think we've gone over this mandate-no mandate business before. The law does not say you must buy insurance. It says you must buy insurance or pay a penalty. You may consider this a mandate if you wish.

The solicitor general did not suggest that one should earn less in order to avoid the mandate. The exchange was begun by Judge Sutton who remarked that a business not wanting to obey civil rights laws had the option of getting out of the business whereas an individual did not have that option.

Note that Katyal (the SG) begins his reply with "If you want to play that game" and ends it with "I think both are kind of fanciful" he then gets interrupted before he can expand his remarks. (judges do that a lot :mad: )

I don't think Katyal was suggesting people earn less in order to avoid insurance, I think he was pointing out that the mandatory coverage does not begin until someone has earned a certain amount. There is a big difference.

Did your obamacare kick in yet?
I've not seen any benefits of the plan in action.

1. I have medicare
2. I have private insurance as a USPS retiree
3. The plan "kicks in" over a period of years.

He said point blank, if you dont like it...earn less. Now you can spin it however, or whenever but, it doesnt change his own words.

it is not a mandate if you buy a policy. Then you are given a fine. Pay the fine and move on.

Does anyone see the problem here?

You're unbelievable. You so glibly and blithely trip over yourself in a contradiction and don't bat an eyelash.

Explain to me what you think a " mandate" is. Is not a "mandate" an authoritative command? In this case, the command is: Do this, or else you do that. And what happens when the person doesn't want to "do that", either?

Bottom line: The law is written in a way that guarantees that the government will extort money out of a person one way or the other. And I suppose prison is the third option for someone who opts out of the first two options. Or maybe a lien against a person's house?
