How do they know if I am surfing the web on my phone, or on my laptop connected to my phone?

They don't. So unless I'm using outrageous amounts of bandwidth (ie. downloading movies or something), I can't see how they can get away with something like this.

that is why I dropped at&t. they are crooks. That is the whole purpose of the internet isn't it?

Think that Sprint commercial with the CEO will have an impact. They have come a long way from not being a major player. Many years ago I bought a broadband card from them and it wouldn't even get a signal. I returned it in less than 24 hours. He has done a tremendous job. :ThmbUp:

The phone can probably forward it's status to the telco - after all it is just a UNIX computer with a transceiver hung on to it.

And now ATT has purchased T-Mobile.

Side note to you ATT customers. They have a new (about a month ago) feature if you use unlimited texting that includes ANY mobile. Like Sprint. As long as you are talking to another cell phone, it doesn't count against your minute pool. Same price as the unlimited text plan you already have. Just need to call them and swap the feature.

They can tell if someone is chewing data on their network by tethering. At least my ATT rep says so.

If your want is to tether or have a hot spot with a mobile phone it's tough to beat $25/mo., Virgin Mobile, unlimited data.

It's basically the Sprint network.
