This will get interesting the contract is very complicated and most likely not one a judge has ever seen. Before we all assume IEAH did something wrong let's wait until they file an answer.

this will be interesting. i have never heard of a horse that got vetted out sale reversed for lack of disclosure.

there are plenty of sales reversed at the auction's for those reason's. it is in the contract, this case depends on the way the contract was drawn up.

Who to route for ? IEAH or Mullins and Lanzman. Is anyone really surprized the upstanding Jeff Mullins would conceal the extent of the injury experienced by I Want Revenge.

When you purchase a horse you do a veterinairy examination with X=rays and scans and scopes.

If the horse passed this test,what more could they want.

If the horse had a problem and they took a chance then it has backfired.

Slewis will probably have an idea on this.

IEAH purchased a half interest in I Want Revenge for $ 3,175,000,$1,750,000 cash and a 25% interest in the filly Stardom bound. There was however more to the deal.It has been reported that had the colt won the Derby IEAH WOULD HAVE HAD TO FORK OVER AN ADDITIONAL $1,000,000 TO LANZMAN. Why am I not surprised Mullins kept the IEAH boys in the dark.

You are 100% correct the vet does a full exam, hopefully it was a vet IEAH selected if so then there isn't much else to the story. If the vet missed something then his mal-practice will be put to the test. If the horse had a minor issue that turned into something major there is no court in the world that will rule in the favor of the buyer.

The colt, who is a half brother to Lanzman's I Want Revenge, is an obvious allusion to the legal troubles Lanzman has had with IEAH Stables, which bought a share in I Want Revenge before the Kentucky Derby. I Want Revenge scratched the morning of the race, and both parties are suing each other for various alleged transgressions (thank you anonymous commenter for the proper edit here).

I actually have heard of several cases that have been reversed but I dont know that exact testimony.

The one that I recall is a Hough trained colt about 9 yrs ago that sold privately for I believe $850,000 that was litigated and the sale might have been reversed.

There was testimony of assistants, etc, and under oath...if there was any sort of coverup, well they may have an arguement.

IEAH should hire the lawyers that work for NYRA. If they can scare the attorneys for the State of NY that NYRA really owned the land, they could pull anything off.
They're better than Cochran and Shapiro.

BTW, It amazes me how people have such a hatred for Ivarone and IEAH while the Sheik's in town to buy lots of stock with the oil money we gave them last year when prices were artificially jacked through the roof.

I guess that doesn't leave a "greasy" taste on anyone's palette, but a bunch of ex-wallstreet guys who made a smart private purchase with Big Brown throws people into a frenzy.

Manhattan District Attorney Robert M. Morgenthau said that A. R. Baron used lies, unauthorized trades and theft to defraud investors of at least $75 million from 1991 to 1996. Iavarone has been involved in other litigation, including a dispute over a bad check for $20,000 written to the Showboat Hotel and Casino in Atlantic City in January 1999, which he eventually paid, according to court records.

Umm... Lets see... 1st horse I ever bought (for less than the price of a mid sized car) placed in 2 graded stakes, earned over a half mil....

First horse I ever bred.... easily went through Alw conditions in NY..stud fee $7k...claimed mare for $10k..

Consulted on the purchase of horses ( Both for under $100k )in successive years that won the Tampa Bay Derby...Placed in this years Kentucky Derby and Preakness.....

Umm.... We actually turned a profit in this game.

Anyone out there a CPA???
