This will vary state to state. If your tax refund seems off or the amounts due seem off then here is one place to look.
If your spouse has a home business and the state requires you to have a tax permit then they also have the right to take part of your refund to apply to future taxes due on the account you set up for a home business. (Remember that $10 Sales Permit Form)
You can get it back, but it is spread out for the next two years, (in this state), under different account numbers. You can get your money by calling the dept of revenue and asking for an audit. Understand this, you don't get the account numbers till you ask for the audit.
I wonder how many people just bitch and move on. I was talking to the bookkeepper at church and she said it is legal and has been that way for awhile but not too many people know this.
Make sure to check past years returns and make sure you got your money.
