If that is so it's too heavy.
I hear it has been challenged.
But the issue here is "tipsters", not car manufacturers, fast food chains-pizza parlours and things like that !
On the other side of the equation we have bookmaker companies (they cannot operate nowadays in USA), doing it all over the place. The best known case internationally being Betandwin bookmakers - BARCELONA FC.
Bookmakers that is can advertise all over the place, subject only to the limitation of their operations being legal or otherwise within the state's borders (& this limitation has nothing to do with their sponsoring an athlete or somebody else).
If I was a jock why could n't I give tips myself to the publc ?
I become a judge of "how much strength a horse needs to win", not "how much strength it needs to lose".
I don't see the impropriety per se.
It takes a lot more than that to make me an offender of some sort.
But those are my theories.
The view taken by racing's bosses matters and we have to abide.
Would they tolerate it or not ?
Let me picture a probable situation:
We hire here in the forum one of the country's top jocks to write as a columnist. We, the forum's owners, strike it rich, because everyone wants to read our famous recruit (my lingering suspicion that we are going to sink like Titanic not withstanding).
In another scenario we don't do that directly but we say "so and so is a guy sponsored by us and he is also wearing the T-shirt with our logo". That amounts to the same thing because everyone will think we have some good last minute info, as a result of our relationship.
Is that allowed or not ?

3769-7-22 Fraudulent practices.
(A) No person shall:
(1) Corruptly give or offer money, share in a bet or offer other benefits to any person having official duties in relation to a race or to any jockey;
(2) Having official duties in relation to a race or any jockey corruptly accept or offer to accept money, share in a bet or any benefit;
(3) Willfully enter or cause to be entered or to start in any race a horse which they know to be unqualified;
(4) Fraudulently offer or receive any amount of money for scratching a horse out of a race;
(5) Without making it known to the officials, be a part owner or act as a trainer of any horse in which a jockey possesses any interest;
(6) Make any bet with or on behalf of any jockey, unless on a horse such jockey is riding;
(7) Offer or give, except through his employer or the owner or trainer of the horse ridden, a jockey any present, money or other reward in connection with his riding in any race;
(8) Accept a ticket or make a bet on any horse other than the one he rides.
(B) If any person be guilty of any corrupt or fraudulent practices in this or any other country, then such person or persons shall be suspended and referred to the commission.
(C) No jockey may accept payment of any kind, directly or indirectly, from any person other than the owner of the horse such jockey rides in a race.
(D) Failure to report fraudulent proposal. If any person shall be approached with any offer or promise of a bribe, or a wager or with a request or suggestion of a bribe, or for any improper, corrupt or fraudulent act in relation to racing, or that any race shall be conducted otherwise than fairly and honestly, it shall be the duty of such person to report the details there of immediately to the presiding state steward. Any person failing to report such information to the state steward shall be suspended and referred to the commission.

It isn't just if a jock is corrupt or not... but he can't even appear corrupt. What we Yanks call checks and balances.

It looks that your rule (C) does not apply, uniformly at any rate.
The question is do you among those listed below recognize any handicapper service / company ?
If it was as you say it is then there 'd be no issue to debate.

For those who don't know....."Pittsburgh Phil", probably the most successful and most secretive handicapper of all time, employed the services of a top jockey of his time (around the early 1900's, I believe)......He paid the jockey a stipend of a certain amount of money each time the jockey had a mount going to post.......He didn't ask anything of the jockey except to try as hard as he could to win with his mount....In the process the jockey was propelled to stardom , and PP probably raked in a lotta-kash in the process, waitng for the ideal situation of horse and rider........He only had contact with the jock that one time.....
