Hsu, a Hong Kong native, was also supposed to turn over his passport Wednesday. Hsu's prominent Silicon Valley criminal defense attorney Jim Brosnahan said Hsu failed to give the passport to the legal team on Monday.

"Mr. Hsu is not here and we do not know where Mr. Hsu is," Brosnahan said outside court. Brosnahan said that "there was some contact" with Hsu a few hours before the scheduled 9 a.m. court appearance, but he declined to say how and who talked to Hsu.

So, at what point does the attorney cross the line by failing to notify the court of his clients intention to flee?

Clinton to Return $850,000 in Donations Tied to Hsu

Sept. 11 (Bloomberg) -- Democratic presidential candidate Hillary Clinton plans to return $850,000 in donations collected by Norman Hsu, a fund-raiser arrested last week on charges of fleeing to avoid sentencing in a 1991 fraud case in California.

``We have decided out of an abundance of caution to return the money he raised,'' campaign spokesman Howard Wolfson said in a statement. Clinton, a New York senator, will send refunds to about 260 donors this week, Wolfson said.

Clinton, 59, counted Hsu among her top fund-raisers until news reports revealed he was a fugitive with ties to a California family with no obvious signs of wealth that donated a combined $200,000 to Democratic candidates. After turning himself in to authorities, Hsu failed to appear for a court hearing in Redwood City, California, on Sept. 5. He was arrested the next day after he became ill and was hospitalized in Colorado.
