View Full Version : Terms Of Use Clarifications

It is my intention with these new Terms Of Use to keep things going as they are, but to offer myself and this website additional legal protection (if that is even possible in this day and age).

Everything (or most everything) that has gone on with this message board - to date - will not change with these new Terms Of Use. I've always frowned upon blatent advertising...the new TOU only clarifies and puts this policy in writing.

It is not my intention to change anything around here, or place any new major restrictions on any type of post. If anyone thinks these new Terms Of Use (which were HEAVILY borrwed from other popular message boards on the net) restrict or prohibit certain things that are currently "allowed", please let me know. I had hoped that these new Terms Of Use simply put into writing what I have been practicing all along.

I think they are good.

As far as advertising, I would still like to see a topic section just for that. I LIKE to know what products are available, and I WELCOME the opportunity to hear from software developers, etc. I just don't want it mixed up with normal conversation. But I wouldn't want it banned altogether either...

Seems very well thought out. Hope it accomplishes what you want it to. I also agree with GT in thinking that a topic section just for commercial use and advertisements. Those who don't like such posts can simply not open the section, just as those who don't like right-wing, reactionary rants don't open the "Off Topic" section now. I like to see what's out there, especially new books. Please consider it if it's not too much extra work or it might get you in legal hot water.

Yes, I agree about the topic section for sellers. I wouldn't want to miss anything real good.

I'd also like to see a "sellers" section just so people can "toot their horn" about their wares and no besmerching what's being touted.

The new TOU are excellent and should forestall the crazies and the malevolent from ruining this wonderful Site.

Game Theory made an excellent point. Let's stay informed of all new handicapping software and techniques. Change is the nature of technology, and handicapping is purely a technological challenge, due to the nature of simulcasting. (When I look back and think that I used to spend 4 hours with the DRF every day, just handicapping one track, AARGH!)

Speed is the single most important aspect of computers, and faster, more powerful handicapping software is our quest.

I never said users or people with knowledge couldn't come here and tell us what is out there....

For instance, Anotherdave recently posted a note telling us about 'At the Races' software, which looks very interesting to me. I'm glad Anotherdave made this post, and his post is completely in line with the new Terms Of Use....

Now, if the creators of "At the Races" software registered for our message board, and their first post was "Come to our site and see what you can buy for $25"....this is the kind of thing I would have a problem with....

Creating a seperate board for sellers is a great idea....except there is one catch. I'd be giving away free advertising, That's not something I'm really inclined to do at this point. I'm actually in a quandry over this aspect of the site. Up until now, I've never accepted any money for any type of advertising. Any ad you've seen on this site was either a link exchange type of ad (you display my ad, I'll display yours), or like the YouBet ads, I would get paid if someone clicked on the ad and signed up for YouBet through my site (never happened...not even ONCE!!!)

In any event, people have and are contacting me looking to buy ad space (mainly, offshore casinos, etc). Until I make the final decision as to whether or not I will accept paid ads, I will put off creating a sellers section of the message board....

Don't be so quick to dismiss the "Off Topic" section, Dick. There are boxcarloads of unintentional humor there. Just today, for instance, we got an endless speech about Judge Bork from a quack who literally does not know how to spell Bork's name.

Why not go back and fix the 147 errors of fact you made in your Middle East string? I have pointed out dozens and offered to point out the others.

Bork Bork Bork. ("Bjork" is at the Derby List.) This sort of problem is common to people who get all their information from television. Read, Boxcar, read. There are many good books about the Supreme Court. I will even give you a few. The authors know how to spell "Bork." I guess they don't want to look like moronic charlatans. An additional plus: They don't reverse their positions every time they watch the Fox News Channel.

Your Bible "factoid" was priceless. I love it when you unknowingly sound like an atheist. Whatever you do, don't look "factoid" up. Wait for Tony Snow to tell you what it means. Why depart from a hilarious formula?
