By ruling 04FRE67 (dated 3/2/04), the Board of Judges at Freehold Raceway found trainer Daniel Sheddan in violation of N.J.A.C. 13:71-23.9(a)13 (Possession of drugs or drug instruments), 13:71-7.29 (Conduct detrimental), 13:71-23.12 (Cooperation), 13:71-23.6 (Protecting against drug administration), 13:71-23.1 (Intent of medication), and13:71-26.5 (Conspiracies) in connection with the horse "Henry Clay." The Board of Judges imposed a 7-year suspension and a total $2,000 fine. In addition, the Judges recommended that the Commission increase the amount of two of the fines issued to the amounts of $2,500 and $5,000, respectively. The Judges also reserved judgment pending further analysis with regard to the charges of possession of prescription legend drugs and unidentifiable injectable foreign substances. Mr. Sheddan appealed the Board of Judges' decision and the matter was transmitted to the Office of Administrative Law as a contested case. The Racing Commission denied Daniel Sheddan's request for a stay of the penalities pending the OAL hearing and Mr. Sheddan remained under suspension effective March 2, 2004. By Notice of Hearing dated June 30, 2004, the Racing Commission alleged that Daniel Sheddan had violated N.J.A.C. 13:71-1.19, 23.6, 23.7, 23.9 (Medication and testing procedures) and N.J.A.C. 13:71-26.5, 26.4, 1.19, 2.1 and 2.3 (Fraudulent practice in relation to racing) in connection with a barn search of his premises conducted on or about February 25, 2004, as well as the analysis of the results seized as a result of that search. The matter was then transmitted to the OAL as a contested case. On June 7, 2005, a plenary hearing was held before ALJ Dubin. Notice was sent to Mr. Sheddan, however, he failed to appear. Due to the seriousness of the violations, the Racing Commission requested to present ex parte proofs. The ALJ then issued his initial decision on Juy 25, 2005. On September 15, 2005, the New Jersey Racing Commission determined to adopt the Initial Decision (dated 7/25/05) of Administrative Law Judge Israel Dubin, which ordered that Daniel Sheddan be permanently expelled from racing in New Jersey, denied the privilege of entering any track or premises licensed by the Racing Commission and fined a total of $7,500 based upon the aforementioned violations.
