Bad News for Trump: An Emoluments Clause Lawsuit Against Him Just Had a Major Win

On Friday evening, just as he was dealing with a setback to his Supreme Court nomination, President Donald Trump got a fresh piece of unwelcome news.

According to a report in the Washington Post, federal district court judge Emmet G. Sullivan ruled that a lawsuit filed against the president by 200 congressional Democrats, alleging he is in violation of the Emoluments Clause of the constitution, can proceed:

"The lawsuit is based on the Constitution’s emoluments clause, which bars presidents from taking payments from foreign states. Trump’s business, which he still owns, has hosted foreign embassy events and visiting foreign officials at its downtown D.C. hotel.

The decision opens up yet another legal front for the president, who is now facing an array of inquiries into his business, his campaign and his charity.

Trump is already facing a separate emoluments suit filed by the attorneys general of Washington, D.C. and Maryland that is moving forward. In addition, he is contending with the ongoing special counsel investigation into Russian interference, a lawsuit from the New York Attorney General that alleged "persistently illegal conduct" at his charitable foundation and a defamation lawsuit brought by former "Apprentice" contestant Summer Zervos."

Yes we do, as originally intended there is no basis to negatively effect our President. As long as the constution is interpeted as intended the high court will rule in favor of President Donald J. Trump. Liberalism is not worth defending.

I think the court system is stacked with a bunch of progressive judges who, LIKE YOU, believe there's a 1,001 shades of color to every law. I mean, didn't Clinton get off the hook for having classified data on her private server; and the excuse they used to not prosecute was that she had no nefarious intentions? Yet, intention is not even mentioned in the statute.

So, obviously, the DOJ/FBI, in her case, pulled a shade of interpretative color out of one of their orifices so that she could escape prosecution. (I'm thinkin' the shade of color was likely dark brown.)

Progressive judges pull the same stunts all the time. Why do you think the 9th Circus out West, where the sun sets, has a such a pathetic record of their decisions surviving in the Supreme Court? :coffee:

Judges are appointed by different administrations. Just because a left wing judge appointed by 0bama feels it is their job to make laws from their interpretation of the constitution, does not make it so.

This might for an interesting follow for wonks like me.....several issues to be considered.

Standing. The first lawsuit by that group of nut cases was predictably thrown out for lack of standing. This case brought by the Dem Congresspersons has been deemed to attain standing by this Judge but may not survive Appelate Court on the issue. Why not?....

Damages. I can't imagine a decent argument for damages being made by this group of plaintiffs. And since there really are no case citations, precedent will not provide any background for establishment. Appelate Courts will not like that....at all. Again, what are the damages and the recourse?

Now, the better case to follow is DC and Maryland vs Trump. Standing has been granted easily and proposed damages are at least plausible. It's all political bullshit, but it could survive Appeals given the circumstance. Long shot, though. 35-1 in my handicapping.

In the end, though, I don't understand why this is deemed to threaten the President's position. These are all......ALL....civil suits....

Impeachment might be possible, I suppose. Conviction in the Senate? Not a damn chance.

Records of the Trump foundation NOW being investigated by the special council, and the Southern District of New York, and the attorney general of NY may tell us just how corrupt he really is

for dims, 'personal wealth' encompasses factors that go well beyond dollars ... it also includes like-ability by your cult and protesting friends, entitlements from your government, and future unearned resources given to you.


I wonder if the NY AG will find Trump had any 'intent' to break local, state and federal laws?
