Anyone know what jockeys are threatning to boycot derby because they can't ware ad's?
If this is the case will the Bud longshot be made to pull the Bud Wagon?

Golf and tennis players are not working for anyone but themselves. Jockey are working for an owner.

How about the boxers? Anyone noticed the ads painted on their backs? Looks ridiculous!

Touring professionals not only are working for themselves, but for their sponsors. What's on that hat, shirt & in the bag had better be there or that independent contractor will be looking for a new source of income.

Unless that individual is Tiger Woods :D :D

Wait tell they put flashing neon signs instead of saddle clothes on the horses or how about banners flying from the horses tail?

Once it starts it will never end. Probably put a Nascar vehical to shame.

The owner pays for his silk, does he not? It is totally selfish for a jock to put on something else and get paid for it himself.

Maybe it's time for Kentucky to follow #1 - New York; Here is their rule that worked just fine last year at The Belmont Stakes.

4041.6. Wearing of advertising or promotional material.

(a) A jockey may not wear any clothing other than the usual helmet, silks, pants, boots and gloves nor display on such clothing any material other than authorized advertising or promotional material without permission of the stewards.

(b) Advertising or promotional material may be worn by a jockey provided such jockey has filed with the stewards and the race track in a form furnished by the board at least 24 hours before the applicable race, a description of the advertising or promotional material to be worn with the name of the brands and sponsors and referring to a written authorization therefor by the managing owner of the horse to be ridden which authorization is also so filed.

(c) Notwithstanding the foregoing when a corporation, company or any other entity sponsors a race or raceday at the track, the track may prohibit such advertising or promotional material from being worn that represents a competitor of such sponsoring corporation, company or other entity. In this regard the track shall notify the stewards of such prohibition at least two hours before the first race of the day, and the jockey upon arrival in the jockeys' enclosure.

Being an old Marketing guy ... advtg..etc. I think it would be a
great new source of income !! And that's what racing needs !!
The old Blue Bloods dont care about money ... ( well at least
they have theirs :) So why not !!
I can see it now .... Smarty Jones sponsored by .. .. .. ..
and so on ! And name each race for whomever wants to put
up the money. Now .. the race is sponsored by the local
Jaycees or the sewing club .. or the Lions club. Let's rocket on

Owners' may own the silks, but not the pants, which is where the jocks want to put the ads.

I think the main reason this has become a problem is because VISA cried foul during the Belmont Stakes last year, with the ads that Bailey and a couple of others wore during the race. They are no doubt crying foul again before the Derby. Are they right? Perhaps.

that's crazy. I didn't know first amendment rights included dressing however you want at work.

Maybe someone should tell those Hot Dog On a Stick people that work at the mall, or even UPS drivers, they are getting the shaft big time. Their rights are being violated. Isn't it lovely how everything is a "right" nowadays.

As a Tm attorney, I agree this is a ridiculous decision.

In fact, I am not sure what would stop the owners/stewards from simply prohibiting the jockey from mounting the horse when the time comes. I heard some talk of this somewhere, not sure if it was internet or TV.

If I was hard core that's what I'd do. Tell the jocks to take it up in court again. The NY rule, posted above seems sensible I cannot imagine it would be overruled by a court on any basis, first amd. or otherwise.

Possibly the owner's did not have a good attorney or he didnt argue the right issues. Anything can happen in a case like that.

First amendment has been applied to businesses from a Sup Court case about 20 years ago. There are still going to be limitations on how far you can go with that, it's implied once you consider the possibilities. I dont see this as a first amendment case though, I simply see this as the right of the ownership/race club to control the uniforms. That cant possibly be overruled by 1st amendment.

I would be careful about outright poo-pooing the idea of "Rights." Rights are the only thing that is standing between you and the government simply picking you out and shooting you.

So yeah everyone has rights. If you dont like it you should have fought harder for King George during the American Revolution or something like that.

Admittedly, though it would be fun to see St. Averil bringing up the rear w/ a large "Elmer's Glue" sign attached to his backside.

This is taking the right away from the employer, the right to not let your employees dress like baffoons and embarass your company in the most public venue possible.

I know it's a "slippery slope" and all, but summary executions? That's a bit of a stretch...

WHy would it matter their status, in any event?

Does anyone argue that the shirts and hats are not part of the uniform? Does anyone argue that they have to wear the shirts and hats? So what is stopping them from saying that the pants are part of the uniform too and subject to regulation. I dot see that criterion as make or break.

Any jockey who shows up with any ads can put them on their pants as far as I am concerned....the back side of those pants and about 8 inches in from the material! Talk about minor league.

Pretty soon, the jockeys will want their own theme music payed when they come out for the post parade..like WWE.
It is bad enough that we have to endure the absolutely ridiculous crap like the Coolmore LExington, the Visa Triple crwon...etc.

What if Levi straus sponsers a rider, does his 1st admendment rights allow him to wear jeans during a race. Via this ruling, company dress codes are now unconstitutional.

Whats next, somebody sueing the Dallas Cowboys because they discriminate based on athletic ability.

If I were an owner, I'd tell the Jockey to pack sand, while your on my horse your working for me. OR demand a cut.

Next thing they'll want is pizza delivered to the jocks room, and a Domino's emblem on their back. Maybe they can paint the cap to look like a pizza with a couple of slices missing !

it shows you how out of touch some judges can be if the decision is as bad as it sounds. You can obviously be fired for dress code violations at places like MacDonald's.
