Idiot Judge decides to make up case law

I guess I would have had to sign on as an owner of one the other horses before betting?

Why did the crown not find an owner of one of the other horses, who had bet on the race? I am sure that could have been done? Yet the other parts of the decision make that a moot point also, I guess.........
